GeoQuestr — Terms of Service

These Terms of Service ("Terms") govern your access to and use of GeoQuestr’s websites, mobile applications, and related services (collectively, the "Services"). GeoQuestr is developed and operated by Wintergarde Development AB, Pataholm 106, 38694, Ålem. ("GeoQuestr", "we", "us", "our"). By using the Services, you agree to these Terms.
If you do not agree, do not use the Services. Additional policies referenced here form part of these Terms: our Privacy Policy, Cookie Policy, and Official Activity Policy.
1. Who May Use the Services
- Age. You must be at least 13 years old (or the minimum age required by your country). If you are under 18, you must have parental/guardian consent. Additional age gates may apply in the EEA per local law.
- Accounts. You must provide accurate information and keep your account secure. You are responsible for activity on your account. One account per person.
- Safety. GeoQuestr involves outdoor activities. Always stay aware of your surroundings. Do not trespass, endanger others, or violate any laws or property rules. You participate at your own risk.
2. Subscriptions, Plans, and Pricing
We offer a free tier and paid monthly subscriptions. Current plans:
- Free: Create 1 activity, play 3 activities per week.
- Explorer (paid): Create 1 activity, play Unlimited activities.
- Creator (paid): Create Unlimited activities and play 3 activities per week.
- Premium (paid): Create Unlimited activities and play Unlimited activities per week.
Price. Unless otherwise stated, prices for paid plans are stated in the pricing section on the website. Prices may change with prior notice as described in Section 16.
Auto‑renewal. Subscriptions renew monthly until canceled. You can cancel any time in your account settings or via the relevant app store; access continues until the end of the current billing period. We do not provide prorated refunds for partial months, except where required by law or by the app store’s rules.
Trials and promotions. Trial eligibility and duration may vary. Unless you cancel before a trial ends, you authorize us to charge the subscription price at renewal.
App store purchases. If you subscribe via Apple App Store or Google Play, their terms govern billing, refunds, and cancellations. Where their terms conflict with these Terms on billing matters, the app store’s terms control.
EU/EEA right of withdrawal. If you are a consumer in the EU/EEA, you typically have 14 days to withdraw from a distance contract. By subscribing and accessing paid features immediately, you acknowledge that performance begins right away and you lose the withdrawal right for that month once delivery of the digital service starts, to the maximum extent permitted by law. This does not affect your right to cancel future renewals.
3. Official Activity & GeoQuestr Royalty Program
3.1 Definitions
- Activity: Any user‑generated experience, route, quiz, cache, challenge, media, or metadata you submit.
- Official activity: An activity we designate as “Official” per the Official Activity Policy (editorial review and/or community signals; quality, safety, originality, compliance).
- Royalty Pool: A pool equal to 10% of GeoQuestr’s Net Profit for a Distribution Period, allocated to eligible holders of Official Activities.
- Net Profit (for this program only): GeoQuestr’s profit from ordinary operations after operating expenses (including hosting, personnel, moderation, payment processing, taxes, and lawful reserves), excluding extraordinary/one‑off items, calculated in accordance with our internal financial statements prepared under applicable Swedish accounting rules. We may publish a brief methodology summary with each distribution.
- Distribution Period: Each calendar Year.
3.2 Eligibility
To participate in distributions from the GeoQuestr Royalty Pool, you must:
- Hold at least one piece of Official Activity and
- Maintain an active paid Explorer, Creator or Premium subscription at the time Official status is granted and on the last day of the Distribution Period and for atleast 60% of the Distribution Period.
If you cancel or your subscription lapses before the end of a Distribution Period, you will not be eligible for that period’s payout. Free‑tier users are not eligible.
3.3 Allocation Formula (high‑level)
We apportion the Royalty Pool among eligible Official Activities using a combination of:
- engagement factors (e.g., completions, session time),
- quality/safety signals (reports, moderation outcomes, rating, quality of content), and
- geographic/community diversity weights.
Exact weights and thresholds will be published in the Official Activity Policy and may change prospectively. We may cap the share from a single creator to support ecosystem diversity.
3.4 Payouts
- Timing. Paid Yearly in arrears within 60 days after the end of each Distribution Period.
- Thresholds. Minimum payout threshold (e.g., 100 SEK) may apply.
- Method. Payouts via supported methods (e.g., bank transfer or payment partner). Fees may apply.
- KYC/Tax. We may require identity verification (KYC) and tax information (e.g., W‑8/W‑9, EU VAT/ID) before paying. You are responsible for your taxes.
- Adjustments. We may withhold, claw back, or offset amounts in cases of fraud, policy violations, or clear errors.
3.5 Nature of the Program
This program is not an investment or security, and does not grant equity, dividends, or profit rights beyond the yearly Royalty Pool. Participation is non‑transferable. We may modify or discontinue the program prospectively with notice (Section 16) but will honor amounts already earned for completed periods, subject to these Terms.
4. Content; License You Grant
- Your rights. You retain ownership of your Content.
- License to us. You grant GeoQuestr a worldwide, non‑exclusive, royalty‑free (except for payments under Section 3), sublicensable license to host, store, cache, reproduce, adapt, publish, translate, publicly perform, display, and distribute your Content to operate, improve, promote, and provide the Services (including in marketing and in‑app placements) and to moderate and enforce policies.
- Feedback. You give us a perpetual, irrevocable license to use feedback without obligation.
- Moral rights. To the extent permitted by law, you waive or agree not to enforce moral rights against GeoQuestr for uses permitted here.
5. Official Activity Policy & Review
- Submission & review. Official designation follows our editorial and safety review. We may request edits or reject for any reason consistent with our policies.
- No guarantee. Payment is only for Official Activities and only while you meet eligibility.
- Removal. We may remove Official status (and future eligibility) for violations, safety issues, or material quality degradation. Past periods already paid are unaffected unless obtained through fraud or policy breaches.
6. Prohibited Conduct
You agree not to:
- cheat or interfere with geolocation (e.g., GPS spoofing), create multiple accounts, or tamper with metrics;
- violate laws or third‑party rights, trespass, or endanger people/animals/property;
- post unlawful, hateful, harassing, misleading, or infringing content;
- scrape, crawl, reverse‑engineer, or access the Services by automated means except as permitted by robots.txt or our written consent;
- sell, rent, or transfer your account or any in‑app virtual items.
We may suspend or terminate accounts to protect users and the platform.
7. Outdoor Safety & Assumption of Risk
GeoQuestr activities may occur near roads, bodies of water, uneven terrain, or on private lands. You are solely responsible for your safety and compliance with laws and signage. Do not play while driving. To the maximum extent permitted by law, you assume all risks associated with participation.
8. Virtual Items
Virtual items or in‑app benefits have no cash value, are non‑transferable, and may be changed or retired at any time. They are separate from the Royalty Pool and do not entitle you to any payment.
9. Third‑Party Services
The Services may link to third‑party sites or integrate third‑party SDKs (analytics, payments, maps). We are not responsible for third‑party content or practices. Your use of third‑party services is at your own risk and may be governed by their terms.
10. Intellectual Property; Notice of Infringement
- Our IP. The Services, including software, designs, text, graphics, and trademarks, are owned by us or our licensors and protected by law.
- Notice procedure. If you believe content infringes your rights, email hello@geoquestr.com with: (a) your contact details; (b) description of the work and the allegedly infringing material (URL/ID); (c) a statement under penalty of perjury that you have a good‑faith belief the use is unauthorized; and (d) your signature. In the U.S., you may send a DMCA‑style notice; in the EU/EEA, we will process under applicable law. We may notify the user and remove or restore content in our discretion.
11. Privacy
Our Privacy Policy explains how we collect and use personal data. Certain features require location services. You can control some data uses via device settings and in‑app controls. For children’s privacy, see the Privacy Policy.
12. Termination
You may stop using the Services at any time. We may suspend or terminate your access (or remove Official status) if you violate these Terms, create risks, or engage in fraud or unlawful activity. Upon termination, Sections that by their nature should survive (including 3, 4, 7, 8, 10, 12–18) will survive.
13. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee uninterrupted or error‑free operation or that activities are safe or available in any location.
14. Limitation of Liability
To the maximum extent permitted by law, GeoQuestr and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party; or (c) unauthorized access, use, or alteration of your content.
Where liability cannot be excluded under mandatory law, our total liability for all claims relating to the Services in any 12‑month period is limited to the greater of (i) the amount you paid us in that period for the Services or (ii) 300 SEK.
Nothing in these Terms excludes liability for fraud, intentional misconduct, or death/personal injury caused by negligence where such exclusion is not permitted by law.
15. Dispute Resolution; Governing Law
EU/EEA & Rest of World (non‑US). These Terms are governed by the laws of Sweden, without regard to conflict‑of‑laws principles, and you may bring claims in your local courts where required by mandatory consumer law, or in the courts of Gothenburg, Sweden.
United States only — Arbitration. If you reside in the U.S., you and GeoQuestr agree to resolve any claim (except small‑claims court and injunctive relief for IP) by binding individual arbitration administered by JAMS under its rules. No class actions. You may opt out by emailing hello@geoquestr.com within 30 days of first acceptance. This Section does not apply where prohibited by law.
16. Changes to the Services or Terms
We may update the Services and these Terms. For material changes (including to the Royalty Pool or pricing), we will provide reasonable advance notice (e.g., 30 days) via the website, in‑app, or email. Changes take effect prospectively. If you continue using the Services after the effective date, you accept the updated Terms. If you do not agree, you must cancel your subscription and stop using the Services before the changes take effect.
17. Communications; Electronic Notices
You consent to receiving electronic communications from us (emails, in‑app messages). Legal notices may be delivered to the email associated with your account.
18. Miscellaneous
- Entire Agreement. These Terms, plus referenced policies, are the entire agreement between you and us.
- Severability. If a provision is unenforceable, the remainder stays in effect.
- No waiver. Failure to enforce is not a waiver.
- Assignment. You may not assign these Terms without our consent. We may assign to an affiliate or in connection with a merger, acquisition, or sale of assets.
- Force Majeure. We are not liable for delays or failures due to events beyond our reasonable control.

- Metrics: engagement, quality/safety, diversity weights (details in Policy).
- Payout window: within 60 days after Distribution Period; min threshold may apply.
- KYC/Tax: required where applicable; you’re responsible for taxes.
- Not an investment; does not grant equity, dividends, or ongoing rights beyond program terms.
- We may update the methodology prospectively with notice.
