1. Terms

Welcome to GeoQuestr, developed by Wintergarde Development AB. Our interactive platform blends gaming with real-world exploration through mobile applications (“Apps”). These Terms of Service ("Terms") govern your use of the GeoQuestr Apps, website at www.geoquestr.com ("Site"), and all related services provided by us (collectively, "Services").

By using our Services, you agree to these Terms. If you do not agree, you must refrain from using the Services. We reserve the right to modify these Terms at any time, and we will notify you by updating them on the Site or within the App. Continued use of the Services constitutes your acceptance of the updated Terms.

IMPORTANT: SECTION 13 BELOW CONTAINS AN ARBITRATION AGREEMENT, WHICH AFFECTS HOW DISPUTES ARE RESOLVED. PLEASE READ CAREFULLY.

If you violate these Terms, we reserve the right to take action, including terminating your account.

2. Privacy

Please review the GeoQuestr Privacy Policy to understand how we collect, use, and protect your personal information. Your use of the Services is subject to the Privacy Policy, which may be updated from time to time.

3. Use of the Services

3.1 Prohibited Behavior

GeoQuestr does not tolerate cheating or any behavior that alters or disrupts the Services. Cheating includes, but is not limited to:

Unauthorized access to Services.
Multiple accounts for the same Service.
GPS spoofing or altering location data.
Selling or trading accounts.

GeoQuestr may take action against any user who engages in cheating, including suspending or terminating accounts without notice.

3.2 Safety and Compliance

When using GeoQuestr, stay aware of your surroundings and comply with local laws. You agree not to upload any inappropriate content or engage in activities that could harm others or damage property.

3.3 Interactions with Others

You are responsible for your interactions with others, both in the virtual world of GeoQuestr and in real life. Harassment, threats, or other illegal activities are strictly prohibited.

3.4 Eligibility

To create an account, you must meet the age requirements outlined in our Privacy Policy. Parents or guardians must provide consent for minors where applicable.

4. Limited License to Use

We grant you a non-exclusive, non-transferable, revocable license to use GeoQuestr for personal, non-commercial purposes, subject to compliance with these Terms.

5. Content and Content Rights

5.1 Content Ownership

GeoQuestr and its licensors retain all ownership rights in the Services. User-generated content ("User Content") remains your property, but by using our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, modify, and display your User Content in connection with operating and promoting the Services.

5.2 Virtual Items

GeoQuestr may allow you to earn or purchase virtual items. These items have no real-world value and cannot be exchanged for real money or transferred to others.

6. Conduct, General Prohibitions, and Enforcement Rights

You agree not to engage in any of the following prohibited activities:

Collecting personal data from other users without consent.
Using automated systems (bots, scrapers) to access Services.
Circumventing security features of the Services.

GeoQuestr reserves the right to monitor and take action against any conduct that violates these Terms.

7. Participation in Events

From time to time, GeoQuestr may host live or in-app events. You agree to comply with all event policies and local laws while participating. GeoQuestr is not responsible for injuries or damages that occur during these events.

8. Sweepstakes, Contests, Surveys, and Promotions

Promotions organized by GeoQuestr may have their own specific terms. By participating, you agree to those terms in addition to these Terms of Service.

9. Beta Programs

GeoQuestr may offer early access to beta versions of our software. Participation in these programs is voluntary and subject to confidentiality agreements. Beta software is provided "as is" without warranties.

10. Third-Party Websites or Resources

GeoQuestr may link to third-party websites. We are not responsible for the content or services provided by these external sites, and you use them at your own risk.

11. Disclaimer of Warranties

To the maximum extent permitted by law, GeoQuestr is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation of the Services.

12. Limitation of Liability

To the extent permitted by law, Wintergarde Development AB is not liable for indirect, incidental, or consequential damages arising from your use of the Services.

13. Arbitration Agreement

13.1 Agreement to Arbitrate

If you are in the US, any disputes between you and GeoQuestr will be resolved by binding arbitration, except for disputes that qualify for small claims court or involve intellectual property rights.
